MARTIN TERMS AND CONDITION, CONSENTS AND OTHER IMPORTANT INFORMATION
Our Role as Your Travel Advisor
Martin Travel Agency, LLC, its parent corporation, subsidiaries and its travel agents ("Martin Travel" "We" "Our" or "Us") are acting as an intermediary between travelers ("You" "Your" "Traveler") and independent travel vendors ("Vendors") in selling travel related products or services, or in accepting reservations or bookings for services such as air and ground transportation, hotel accommodations, meals, tours, and cruises provided by Vendors. The following terms are also in place when Martin Travel is operating as the Agent and Tour Operator, but not as the vendor of accommodations, transportation, or any other tour or cruise services.
You agree to abide by the terms or conditions of the booking imposed by the Vendor(s) with whom you elect to deal. We maintain no control over the action of these Vendors and, therefore, shall not be responsible for the actions of these Vendors, their breach of contract, their failure to comply with any laws, or any intentional or negligent actions or omissions on the part of such Vendors or Vendors` subcontractors, which result in any loss, damage, delay, inconvenience or injury to Traveler or Traveler`s companions or group members.
For tours that are arranged and operated by Martin Travel, where Martin Travel acts only as an agent in matters pertaining to hotel accommodations, transportation, sightseeing, and all other tour arrangements as advertised, and, as such, Martin Travel assumes no responsibility for departures or arrivals, loss, damage or injury to person or property, mechanical defect or failure of any nature, howsoever caused or arising, for substitution of hotels or suppliers, with or without notice, and for any additional expenses occasioned thereby. We reserve the right to vary itineraries and substitute the best alternate features available. Martin Travel shall have no liability or incur any responsibility as a common carrier. Tour responsibility and conditions will be outlined in full on passenger documents issued prior to departure.
Martin Travel reserves the right to decline to accept or retain any person as a member of any tour at any time, and to cancel or alter the tour as may be required for operational reasons. Martin Travel accepts no responsibility to reimburse any passenger who may be removed from a tour for any reason.
In addition to, and not in limitation of, the foregoing, Martin Travel has no special knowledge regarding the financial condition of the Vendors, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel. For information concerning possible dangers at destinations, Martin Travel recommends contacting the Travel Warnings Section of the U.S. State Department at (202) 647-5225 or www.travel.state.gov. For medical information, Martin Travel recommends contacting the Centers for Disease Control at (877) FYI-TRIP or www.cdc.gov/travel. You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s). You hereby release Martin Travel from all claims arising out of any problem covered in this paragraph, and to submit all other claims against Us within thirty (30) days after You return from Your trip. You agree that the courts of Cincinnati, Ohio will be the exclusive jurisdiction for all claims brought by You or Martin Travel, and You hereby submit to the personal jurisdiction of those courts.
In addition, You agree and understand that Martin Travel is not responsible and cannot control factors, both direct or indirect, which may arise as a result of weather, natural disasters, Acts of God, government actions, social or labor unrest, war, political or national strike, terrorist activities, mechanical failures, climatic conditions, epidemics/pandemics, or any other actions or omissions outside of Martin Travel`s control. This also includes service delays, mechanical breakdowns, a Traveler`s medical or physical condition, or a Traveler`s failure to obtain necessary documents or to follow travel instructions. Also, we shall not be responsible for any loss or damage arising from physical or emotional injury to you or to your property, or other economic damage caused by any trip-related event.
COVID-19 Disclaimer: As the worldwide COVID-19 coronavirus pandemic remains ongoing at this time, You acknowledge that for this reason, and other reasons not reasonably foreseeable at this time, Your travel plans may be interrupted or cancelled by the Vendor or Vendors that are providing them, a government entity or other third party over which Martin Travel has no control. You further acknowledge that the Vendor`s own cancellation, rebooking and refund policies, subject to any applicable law that is now or may later be in effect, will govern Your rights and remedies, including Your right to receive a refund, in such an event. Moreover, You understand that should You elect to purchase travel insurance, the terms of such policy will dictate whether, and to what extent, coverage for any financial loss may exist under the circumstances. You hereby agree to hold Martin Travel harmless and release it from any and all liability for any damages, including but not limited to monetary losses, that You may incur as a result of such interruption or cancellation of Your travel plans.
Travel Payments Fares, rates, charges, schedules and other aspects of services provided by the Vendors may change with or without notice after you have completed your purchase. Fares are based on costs and U.S. exchange rates at time of publishing. Should the cost or exchange rate change, a surcharge may be made on the price of your vacation. You hereby acknowledge and agree that, for airline tickets and air-inclusive tours (a tour or cruise package that includes airfare sold by the Vendor), prices are subject to increase prior to the time you make full payment, and however, prices are not subject to increase after you make full payment, except for charges resulting from increased government-imposed taxes or fees. You hereby consent to this price increase policy and authorize Martin Travel to charge your credit card for such additional amounts.
Additional fuel surcharges may be imposed at any time by the tour operator or cruise line, up to and including time of departure. When notified of the fees, you acknowledge and agree that the additional fees are your responsibility and may be required for release of travel documents. Documents will not be available until full payment has been received and all traveler (such as legal name matches form of identification) and itinerary details are verified. Your Martin Travel Agent will make every effort to notify you when the tour or cruise vendor gives advance notice. In the event a Vendor declares bankruptcy, it is not obligated to render services or to provide refunds. Your travel payments are remitted to individual Vendors, and therefore, We are unable to refund Your payment in the event of Vendor default, including bankruptcy. If an airline or other travel vendor declares bankruptcy, it might continue services or stop them completely. We strongly recommend that you use a credit card for your purchase, so that you can exercise your rights under the Fair Credit Billing Act if you do not receive the services you purchased.
Your Travel Advisor recommended that these travel arrangements be charged to your credit card.
Traveling with a Child if you are traveling with a minor child who is not accompanied by both legal parents, special restrictions and documentation requirements may apply. Discuss this with your Martin Travel Advisor for details.
Review All Change and Cancellation Policies and Fees Most airline tickets are non-refundable from the time of purchase. If you cannot travel, your ticket must be cancelled before departure, or that ticket may become unusable later. Cruise lines, tour operators, and other travel Vendors have terms and conditions specific to their products. Be sure you fully understand any restrictions, cancellation and/or change fees that may apply. Your advisor will be able to assist you.
Some packages are based on nonrefundable airfares. If flight change requests or cancellations are received after deposit has been made, or if flights are canceled after tickets are issued, change fees or airline penalties will be applicable. Air taxes and fees are not included in rates unless otherwise noted.
When Martin Travel is operating as the Agent and Tour Operator, we reserve the right to cancel any trip for any reason, including insufficient trip enrollment. Martin Travel reserves the right to change an escorted group departure to an independent departure should the number of booked passengers not meet our minimum requirements. Martin Travel is not responsible for expenses incurred by guests in preparing for a cancelled trip, including but not limited to, nonrefundable airline tickets, visa fees, inoculations, equipment, etc. We encourage you to contact your local Martin Travel Agent prior to purchasing your airline tickets to check the status of your trip.
Protect Your Investment - Purchase Travel Insurance You hereby acknowledge that you have been advised that penalties may apply to changing or canceling a travel purchase and have been offered travel insurance for this trip. We strongly recommend travel protection insurance, which will protect you should you need medical care while on your trip, or should you need to cancel your trip for a covered reason. We strongly suggest you consider purchasing travel insurance since your personal insurance may not provide adequate coverage. Ask your travel advisor for a brochure, or purchase coverage from an insurance carrier of your choice.
Your receipt of an invoice from us, you agree that you thoroughly understand and accept the travel arrangements, terms and conditions contained herein and your invoice for all parties traveling on this trip. You also agree if paying by credit card you have given us permission to charge your credit card. You also agree to review the same information and all aspects of this transaction with all parties traveling on this trip.
Once purchased, travel protection premiums are non-refundable.
